1. Agreement
These terms cover your use of daniellubin.com, run by Daniel Lubin. By using the site, you agree to them.
2. Client services
Web design, software and automation projects are covered by a written proposal or statement of work. If that document and these terms disagree, the proposal wins.
3. Payment
Payment terms are set in each proposal. Default: 50% to start and 50% at launch. Late invoices may pause work.
4. Ownership
Once you pay in full, you own the custom code, design and content made for your project. I may reuse general tools and know-how that are not specific to you. I may show the project in my portfolio unless we agree otherwise in writing.
5. Store purchases
Templates bought in the store are digital products. Your use is covered by the Template License. Refunds follow the Refund Policy.
6. Your responsibilities
You confirm you have the rights to any content, logos or data you give me. You are responsible for the accounts and tools you connect, like your email, CRM or payment accounts.
7. Acceptable use
Do not try to break, overload, scrape or misuse the site, or use it for anything illegal.
8. No guarantees beyond what is written
The site and free content are provided as is. Any promise about results, such as a launch date guarantee, is only binding when it is written into your proposal.
9. Limit of liability
To the extent the law allows, my total liability for any claim is limited to the amount you paid me for the service or product involved. I am not liable for lost profits or indirect losses.
10. Governing law
These terms are governed by the laws of the State of Texas. Any dispute goes to the courts in Dallas County, Texas.
11. Changes
I may update these terms. The date at the top shows the latest version.
